§ 19-98. Steps for implementation of mandatory sewer hook-up.

  • The following steps and procedures shall be applicable in order to facilitate mandatory sewer hook-up:

    (1)

    After the current wastewater treatment plant additions are completed, written notification to all property owners within the city limits not currently on the sewer system will be mailed by first class mail to such owners of such property as listed on the county tax records.

    (2)

    Such written notification shall indicate the various options available to the property owner in connection with hook-up to the city sewer system.

    (3)

    Public notice concerning the mandatory sewer connection policy will be published in the State Port Pilot after completion of the wastewater treatment plant.

    (4)

    Those persons or owners not presently on the city sewer system who apply for sewer connection within sixty (60) days from the letter of notification shall be given until January 1, 1989, to pay the sewer tap and impact fee of one thousand two hundred dollars ($1,200.00) without interest. After January 1, 1989, interest shall accrue at the rate of nine (9) percent per annum upon any unpaid balance.

    (5)

    A six-month grace period from July 1, 1988, will be given before customers will be charged a sewer use fee.

    (6)

    Those owners and customers who have not applied for sewer service within sixty (60) days from the letter of notification shall have until January 1, 1989, to apply for such service with the following payment options (interest shall begin to accrue sixty (60) days from the letter of notification):

    a.

    Twelve (12) monthly payments of $ ____________ each, including interest at six (6) percent.

    b.

    Twenty-four (24) monthly payments of $ ____________ each, including interest at seven (7) percent.

    c.

    Thirty-six (36) monthly payments of $ ____________ each, including interest at eight (8) percent.

    d.

    Forty-eight (48) monthly payments of $ ____________ each, including interest at nine (9) percent.

    e.

    Sixty (60) monthly payments of $ ____________ each, including interest at ten (10) percent.

    f.

    Longer payment periods may be approved by the board of aldermen upon a showing of hardship by the property owner.

    (7)

    Those customers who do not affirmatively select an option set forth above by January 1, 1989, may be connected to the sewer system by city personnel and charged for this connection in addition to the sewer tap and impact fee. Such charges shall be due and payable upon connection and a lien will be placed on the owner's property in the event that payment is not made immediately.
