§ 4-116. Generally.

  • Home occupation: Any business, profession or trade in which the principal income-generating work of the business, profession or trade is conducted principally within a dwelling unit or accessory structure by the inhabitants of the dwelling unit, which business use is incidental and secondary to the use of the property for dwelling purposes. Furthermore, in order to be classified as a home occupation, the business, profession, or trade must satisfy the following requirements:

    (1)

    Not more than twenty-five (25) percent of the gross floor area of the dwelling unit (excluding porch and garage areas) or five hundred (500) square feet, whichever is more, shall be used in the conduct of the home occupation. The twenty-five (25) percent or five hundred (500) square feet, whichever is more, may be used in either the dwelling unit or an accessory structure or a combination of the two (2).

    (2)

    There shall be no change in the outside appearance of the building or premises, or other visible evidence of the conduct of such home occupation other than one (1) sign, not exceeding eighteen (18) inches by twenty-five (25) inches in size, and may be lighted with indirect illumination of not more than seventy-five (75) watts per side and shall not be illuminated from 10 p.m. till 8 a.m.

    (3)

    There shall be no outside storage of anything connected with the home occupation, except one (1) vehicle used in connection with the business. Such vehicle may be no larger than a passenger van or pick-up truck.

    (4)

    No traffic shall be generated by such home occupation in greater volumes than would normally be expected in a residential neighborhood, and any need for parking generated by the conduct of such home occupation shall be in accordance with § 4-117 of this article, and other than in a required front yard.

    (5)

    No equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes, odors or electrical interferences detectable to the normal sense off the lot. In the case of electrical interference, no equipment or process shall be used which creates visual or audible interference in any radio or television receivers off the premises, or causes fluctuations in line voltage off the premises.

    (6)

    There shall not be more than one (1) person other than residents of the dwelling unit employed at the premises in connection with the home occupation.

    (7)

    In the event a home occupation is being conducted at the time of the adoption of this article which does not comply with the requirements of subsection (a) hereof, said home occupation may continue provided that all requirements of subsections (b) through (f) are complied with. Any home occupation not complying with all requirements of subsections (b) through (f) is in violation of the Southport Zoning Ordinance and subject to all remedies allowed by law. If said home occupation does not meet the restrictions in subsection (a) at the time of the adoption of this article, no action can be taken to increase the non-conformity in any manner.
